Primer is a technical intermediary platform working with licensed payment service providers. Primer does not sell merchants' products itself and is not the seller of record for merchant transactions conducted on the platform. Each merchant is solely and exclusively responsible for the legality of their products, the accuracy of product descriptions and pricing, and compliance with all applicable laws, regulations and the rules of the payment processor. By using Primer to list and sell products, merchants acknowledge and accept these obligations in full.
The following categories of products and services are strictly prohibited on Primer and may not be listed, offered, sold or advertised under any circumstances: (a) any goods or services whose production, distribution, sale or possession is illegal under applicable law, including but not limited to any relevant EU, German or international regulations; (b) weapons, firearms, ammunition, and accessories subject to weapons-law restrictions, or any devices designed to circumvent such restrictions; (c) narcotics, controlled substances, prescription-only pharmaceuticals, and analogues or precursors thereof, irrespective of claimed intended use; (d) counterfeit, pirated, or intellectual-property-infringing goods, including unlicensed software keys, cracked games, and clone products; (e) stolen goods, goods obtained through fraud, or goods the seller cannot demonstrate lawful title to; (f) adult content of any kind involving minors; (g) emissions-defeat devices, software, or hardware designed or marketed to disable, bypass, or manipulate vehicle on-board diagnostics (OBD), exhaust after-treatment systems, EGR, DPF, SCR/AdBlue systems or any other emissions-control component in a manner that causes the vehicle to exceed legally permitted emission limits when operated on public roads; and (h) any product, service or content that a payment processor used by the platform (e.g. Stripe or Paddle) expressly prohibits on its platform.
The following categories are permitted only when sold with full and accurate disclosure, in compliance with all applicable laws, and where all mandatory legal preconditions are met: (a) Vehicle tuning software, ECU calibration files, and related digital licences — permitted exclusively where the merchant clearly and prominently states the intended use (e.g. closed-course motorsport or off-road use where road approval is not required). The merchant must not advertise, describe, or position the product in a way that promotes or enables illegal modifications, emissions defeat, or any use that would cause the vehicle to fall outside the type-approval or road-legal requirements applicable in the end-user's jurisdiction. Descriptions that exclusively reference legal use cases (e.g. "track use only", "not for road use") are required. (b) Age-restricted goods (including alcohol, tobacco and products with minimum-age requirements) — the merchant is responsible for implementing and documenting a suitable age-verification mechanism and ensuring compliance with applicable age-restriction regulations. (c) Products subject to export controls or sanctions — the merchant must screen buyers against applicable export-control lists and must not fulfil orders in violation of EU, US, or other applicable sanctions regimes.
Each merchant using Primer operates as the seller of record (Modell B) for their transactions. This means that the merchant enters into the contract of sale directly with the buyer, bears full product liability, and is solely responsible for: (i) truthful, accurate, and complete product descriptions; (ii) compliance with all applicable consumer-protection, product-safety, and product-liability laws in the jurisdictions in which they sell; (iii) obtaining all permits, licences, certifications, and authorisations required to sell the listed products; (iv) collecting, remitting and reporting applicable taxes; and (v) adherence to the current prohibited- and restricted-businesses policies of the payment processors used by the platform. Primer reserves the right to request evidence of compliance at any time and to act on the basis of complaints or regulator requests.
Primer monitors the platform for violations on a best-efforts basis. Upon becoming aware of a potential violation of this Acceptable Use Policy, Primer may, at its sole discretion and without prior notice: suspend or permanently remove the listing concerned; suspend or terminate the merchant's account; withhold pending payouts pending investigation; and report the matter to competent authorities or to the payment processor where legally required or appropriate. Repeat violations or intentional circumvention of these rules will result in permanent account termination.
